Can Bail Be Posted on Out of County Holds?

Jeff Downer  There are instances when when someone is arrested in one county on a warrant issued by another county.  After such arrests the defendant is transported to the local jail to await transfer to the jurisdiction which issued the warrant.  This scenario is described as being held on an out of county hold.

One of the first questions always asked is whether a bail bond can be posted immediately or must the defendant be transferred before bail may be made.  The answer is the defendant must be transferred to the county from which the warrant is issued before any bail bond may be posted.

That is not to say that occasionally a county may decline to come fetch the defendant or the underlying reason for the warrant cannot be addressed resulting in the release of the defendant prior to any transfer.  An example of this circumstance could be the defendant has unpaid financial obligations to the court such as fines and costs.  It may be possible in this situation to pay the fines and costs and have the warrant recalled.

The bottom line is that when a person is arrested on an out of county hold, be prepared to for a wait of several days before the defendant will be eligible to be released on bail.

Betcha Can’t Steal Just One

It seems that the Frito Banditos had brought along a hyperactive two year old who attracted some unwanted law enforcement attention.   This is why you do not use toddlers as a lookout.  Besides that they eat all the profits.

International Bail Bond Scams

Jeff Downer  There has been a widespread scam involving the posting of bail bonds overseas that I would like to alert folks about, particularly grandparents.  This scam is not new but it doesn’t seem to be going away so I thought it is worth making sure folks were aware of it.

The premise of the scam is straightforward:

  • A grandparent receives a call from someone pretending to be a grandchild and/or a person acting on their behalf.
  • A false story is spun about the grandchild traveling to another country (usually Latin America), being arrested and needing bail money wired overseas.
  • That time is of the essence is emphasized to create a sense of frenzied urgency.
  • The grandparents are also urged not to contact the grandchild’s parents to avoid further family drama.

The steps to defeat the scammers are just common sense and easy to implement:

  • Don’t get flustered.  Take some time to think the situation over.
  • Ask specific questions when contacted to verify that it is indeed the grandchild in question
  • Try to call or contact the grandchild directly as well as other family members to determine what the true situation is.
  • Ask law enforcement to verify the story.

Here two news media accounts of how international bail scammers were thwarted in Massachusetts and Maine.  In one case it was simple as as calling the grandchild at home.

Finally, the FBI has issued a bulletin describing the scam and outlining what to do when contacted by potential scammers and what actions to take if you are already a victim.

Scout Willis: Keeping America Safe

Jeff Downer  Scout Willis, Demi Moore and Bruce Willis’s teenage daughter, recently was arrested in New York City for underage drinking after quaffing a Pakistani beer in a public place.

 

They brew beer in Pakistan?  For God’s sake don’t tell the Taliban!  They frown on alcohol.  As Americans we should be reaching out to Pakistani beer drinkers and breweries.

So why is NYC prosecuting Scout and making her post a bail bond?  They ought to instead give Scout a medal for opposing terrorism through conspicuous consumption..  Yippee-ki-yay mother….burrrp!
